General Terms and Conditions Aqualetics – Sundrbi GmbH

The following general terms and conditions apply to the "Aqualetics" offering of Sundrbi GmbH. Separate general terms and conditions apply to the sale of goods via the online shop.

Below are the specific terms and conditions for each offer category

Courses, trainings, workshops, lessons

Registration

Registration is via online registration, email, or mail. Registration is binding and only applies to the corresponding course. Places will be allocated on a first-come, first-served basis. Course participants who are already attending or have attended an Aqualetics course will have priority until the specific date communicated.

Offer confirmation and invoice

With the written confirmation of the offer, the registration becomes legally binding and the course fee/participation fee is due. The offer confirmation will be sent by mail or email at least 7 days before the start of the offer – in case of delays, you will be informed accordingly. If the minimum number of participants specified in the offer is not reached, the offer will not take place. Participants will be informed by email at least 7 days before the start of the offer, and any course fee/participation fee already paid will be refunded in the form of a credit to the customer account.

Payment terms

The course fee/participation fee must be paid no later than the fourth lesson after the start of the course. If you join during the course, the first lesson counts as the start of the course. Cash payments are not accepted.

Early cancellation of offer

Cancellations by participants must be made in writing. Cancellations received up to 7 days before the start of the course will be charged 50% of the course fee/participation fee plus a CHF 25.00 processing fee. Cancellations received after this time will be charged 75% of the course fee/participation fee plus a CHF 25.00 processing fee.

Outdoor offers

If the classes take place in an outdoor pool or other outdoor location (e.g., river, lake, outdoor pool), the lesson may be canceled due to thunderstorms or other weather/water conditions (e.g., cold). The canceled lesson will be credited to the participant.

Indoor pool entrance

Start of offer – Security

In children's courses, parents are solely responsible for their child until immediately before and after the lesson. The course instructors are responsible for the swimming lesson itself.

We recommend that all participants arrive 5 minutes before the start of the session.

Absences of participants

Missed lessons/appointments cannot be compensated or made up. Attendance at an Aqualetics session is personal and cannot be taken by another person. This also applies in the event of quarantine, isolation, accident, or illness, with or without a doctor's note. Any cancellation insurance is the responsibility of the participant.

Absences of participants – exception aqua fitness

Please note that the general absence policy also applies to aqua fitness classes. However, we will organize pre- and catch-up sessions where possible.

Catch up on or make up for missed aqua fitness lessons

Due to the new customer portal software, a maximum of 3 missed aqua fitness lessons can now be made up or rescheduled within the current course cycle.

If participants are unable to attend, they can switch to another 60-minute or 45-minute aqua fitness class. This is provided there is sufficient space in the class and the office finds and confirms a suitable rescheduled date. Procedure: Participants should contact the Aqualetics office in advance by email (info@aqualetics.ch) or phone. The Aqualetics office will provide information about which class can be used to make up the missed lesson.

Important: It cannot be guaranteed that a suitable pre- or post-appointment date will be found, as there are many dependencies.

Instructor absences

Instructors (coaches) are generally responsible for the entire program. For important reasons, they may be substituted by another instructor without prior notice. In emergencies, a lesson may be canceled at short notice without any right to compensation.

exclusion

If a participant or accompanying person significantly disrupts an activity, endangers other participants or violates the regulations of the respective indoor pool, the staff and Aqualetics are entitled, after unsuccessfully issuing a warning, to terminate the contract with immediate effect and exclude the course participant or accompanying person from the activity.

Subscriptions

Aqualetics subscriptions offer a long-term booking option for courses. With a subscription, your place is automatically reserved for upcoming course dates without the need for re-registration. Automatic booking for subsequent courses takes place four weeks before the course begins. Participants will be notified of new course dates and invoices by email. Cancellation of the subscription must be submitted via the customer portal or by email to info@aqualetics.ch no later than four weeks before the end of the current course. A refund of any course fees already paid will be credited to the customer account if a course is canceled due to force majeure. Aqualetics reserves the right to terminate the contract without notice in the event of violations of the General Terms and Conditions or non-payment.

Private lessons and personal training

These terms and conditions supplement Aqualetics' general terms and conditions, specifically for private lessons.

Agreement on lessons

The contact point for scheduling lessons is generally the Aqualetics back office (info@aqualetics.ch). Additional lessons can be scheduled directly with the Aqualetics coach. The Aqualetics coach will report the agreed appointments to the back office.

Confirmation of participation and invoice

With the written confirmation of participation, the registration becomes legally binding and the lesson or course fee is due.

For organizational reasons, we reserve the right to reschedule the private course. If this is not possible for the participant, the booking can be canceled. This is to prevent any unused lessons. If the private course cannot take place at all, we will contact you within the next 48 hours (Monday - Friday) with possible options.

Cancellations of private courses

Early cancellations by participants must be made in writing. Cancellations received up to 7 days before the start of the course will be charged 50% of the due amount plus a CHF 25.00 processing fee. Cancellations received after this time will be charged 75% of the due amount plus a CHF 25.00 processing fee.

Cancellations of private lessons

Cancellations for private swimming lessons by the customer must be made in writing. The cancellation conditions for private lessons do not apply to private courses. Cancellations for private lessons are handled as follows:

Short-term cancellation of the lesson: if the lesson is cancelled less than 24 hours before the start of the lesson, the full lesson fee must be paid.
Mid-term cancellation of the lesson: if the lesson is cancelled between 24 and 48 hours before the start of the lesson, 50% of the lesson fee must be paid.
Long-term cancellation: If the lesson is cancelled more than 48 hours before the start of the lesson, there will be no charge or the lesson can be rescheduled for a later date.

Cancellations of intensive private lessons (several days in a row)

Missed lessons/appointments will not be compensated or made up. Attendance at intensive private lessons is personal and cannot be substituted for by another person. This also applies in the event of an accident or illness, with or without a doctor's note. Any cancellation insurance is the responsibility of the participant.

Private outdoor lessons

If the private lesson takes place in an outdoor pool or other outdoor location (e.g., river, lake, outdoor pool), the lesson may be canceled due to thunderstorms or other weather/water conditions (e.g., cold). The canceled lesson will be credited to the participant.

Gift vouchers

Gift vouchers

Sundrbi GmbH offers the opportunity to purchase gift vouchers for Aqualetics products.

Purchase of gift vouchers

The purchase contract for the gift vouchers is concluded as soon as the order has been confirmed by Aqualetics. This confirmation (via email) is usually sent within 24 hours of receipt of payment.

The relevant voucher code will be sent with the confirmation – as a PDF (via email). The gift vouchers are not personalized. Therefore, they are transferable at any time; however, commercial resale is prohibited.

If the voucher code is lost or stolen, no refund of the purchase price is possible.

Validity of the gift voucher

Purchased gift vouchers can only be used once and must generally be redeemed within 12 months of the date of issue. Unredeemed gift vouchers or remaining balances expire after the expiration date and are non-refundable. Gift vouchers purchased for Aqualetics are valid exclusively for Aqualetics products and cannot be transferred to any other Sundrbi GmbH offer.

Redeem the gift voucher/voucher code

The voucher code can be entered with every order. When ordering online, please enter the voucher code in the "Remarks" field provided. Any excess value from the voucher resulting from booking a cheaper offer will remain with the gift voucher. Refunds and cash payments of the remaining balance are not possible.

Generally valid for all offers

Bathing rules / regulations

The respective specifications, rules and regulations of the indoor swimming pools, outdoor pools and other venues apply.

Health

Participants are strictly prohibited from swimming if they have the following symptoms: fever, ear or eye infections, diarrhea, contagious diseases, lice, severe cold, or severe cough.

Photo and film

Taking photographs and filming of swimming lessons is prohibited in the indoor/outdoor pool areas. Sundrbi GmbH may permit photography and filming upon justified request. Bringing cameras, mobile phones, etc. into the indoor/outdoor pool areas is prohibited.

Swimwear

Only swimsuits and shorts are permitted in the water. Surf shorts are not permitted. Wearing full swimsuits is recommended, as bikinis are unsuitable for swimming lessons. Wearing underwear under swimwear is strictly prohibited. Only swimwear or T-shirts and athletic shorts are permitted in the pool. This also applies to all visitors, including those accompanying participants.

Insurance

Participants are responsible for insurance. Neither Sundrbi GmbH nor the swimming pool operators are liable for damage, theft, or loss of items.

health insurance

A contribution from the health insurance company must be obtained directly from the insurance company. Participation in the offer will be confirmed by Sundrbi GmbH upon request.

Program and price changes

Program and price changes are reserved for future offers.

Protection concept

If a safety plan is in place for Aqualetics' services, it must be followed. Customers and employees adhere to the rules and regulations. They regularly inform themselves about changes.

The rules, regulations and protection concepts can change at any time and must be accepted and adhered to by all Aqualetics employees and customers.

Cancellation/postponement of offers

Sundrbi GmbH reserves the right to cancel or postpone offers. If, at Sundrbi GmbH's discretion, the general conditions are not suitable, Sundrbi GmbH may cancel and/or postpone an offer. In this case, canceled offers will be refunded if possible. The refund will be made in the form of customer credit, which can be used flexibly for other offers.

Ethics Charter

Sundrbi GmH adheres to the principles of the Swiss Olympic Ethics Charter.

Force majeure

Sundrbi GmbH cannot guarantee the use of indoor swimming pools, rivers, lakes, and other sports facilities. For courses that cannot be held due to closure, operational disruption, or force majeure (e.g., natural disasters, viruses, pandemics, epidemics, energy crises, war, or the threat of war), course fees will not be refunded or credited toward subsequent courses.

Data protection

The statutory data protection regulations apply.

Place of jurisdiction

Swiss law applies. The place of jurisdiction is Arlesheim.
